General Terms and Conditions of Sale

In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:

  • "Takeaway/We/Us/Our" means Delight Burger.

  • "Orderra" means Orderra Ltd, a company registered in England and Wales under number 16588132, whose registered office is at 71–75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ, and whose website is www.orderra.co.uk. Orderra operates and provides access to the Website/Application in the United Kingdom.

  • "RestaJet" means the company that owns and provides the underlying online ordering platform technology used for the Website/Application. RestaJet does not sell food or enter into contracts for the sale of goods with customers.

  • "Website" means www.delightburgerdronfield.co.uk.

  • "Application" means the Delight Burger mobile application that you use for placing food orders.

These Terms and Conditions govern the sale of all goods by us and will form the basis of the contract between you and us. If you wish to place an order with us, our Website/Application will guide you through the ordering process. Before submitting your order to us, you will be given the opportunity to review and amend it. Please ensure that you have checked your order and that you have read these Terms and Conditions carefully before submitting it. If you are unsure about any part of these Terms and Conditions, please ask us for clarification.


1. Company Structure and Platform Roles

1.1 RestaJet as platform provider
RestaJet is the technology provider of the online ordering platform used by the Takeaway. RestaJet is responsible only for supplying and maintaining the software platform and does not act as a seller of food or as a party to any contract for the sale of goods between you and the Takeaway.

1.2 Orderra as UK distributor and service provider
Orderra Ltd is a company registered in the United Kingdom and holds the distribution and commercial rights to provide and support the RestaJet platform in the UK. Orderra operates the Website/Application in the UK and may provide customer support and related services in connection with your use of the Website/Application and your online orders.

1.3 Who you are dealing with

  • Your contract for the purchase of food and drink is always with Delight Burger as the Takeaway.

  • For the use of the Website/Application, processing of online payments and related support, you will primarily interact with Orderra Ltd as the operator of the platform in the UK.

Nothing in this section affects your rights as a consumer or changes the fact that Delight Burger is responsible for preparing and supplying your order.


2. Our Contract

All orders are subject to availability and confirmation of the order price. Dispatch and collection times may vary according to availability and are subject to any delays resulting from circumstances beyond our reasonable control (including, but not limited to, force majeure events), for which we will not be responsible.

In order to contract with Delight Burger you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. Delight Burger retains the right to refuse any request made by you.

If your order is accepted, we will inform you by email, SMS or via the Website/Application. When placing an order, you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods.

When you place an order, you will receive an acknowledgement email and/or webpage confirming receipt of your order. This email and/or webpage is only an acknowledgement and will not constitute acceptance of your order. A contract between you and us will not be formed until we send you confirmation, by the medium used for placing the order (SMS, e-mail or other appropriate digital means), that the goods you ordered have been dispatched or are ready for collection. Only those goods listed in the confirmation sent at the time of dispatch/collection will be included in the contract formed.


3. Pricing and Availability

Whilst we try to ensure that all details, descriptions and prices which appear on the Website/Application are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered, we will inform you of this as soon as possible and give you the option of either reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund from Delight Burger.

Delivery costs (if applicable) will be charged in addition. Such additional charges are clearly displayed where applicable and included in the “Total Cost”.


4. Payment

All online card payments made through the Website/Application are processed securely by Ryft Pay Ltd (“Ryft”), our third-party payment service provider.

Upon receiving your order, a standard authorisation check may be carried out on your payment card to ensure there are sufficient funds to fulfil the transaction. Your card will be debited upon authorisation being received. The monies received upon the debiting of your card shall be treated as full payment against the value of the goods you wish to purchase. Once the goods have been dispatched or are ready for collection and you have been sent a confirmation email, SMS or notification on the Website/Application, the monies paid shall be applied to the value of the goods you have purchased as listed in that confirmation.


5. Delivery Estimates

Times given for collection and delivery are only approximate. Neither Orderra nor the Takeaway can provide an exact time for delivery but will endeavour to deliver within the approximate delivery time specified when you place your order.


6. Refunds & Charge-backs

Online payments made for orders placed via the Website/Application are processed by Ryft Pay Ltd.

If you wish to request a refund, dispute a transaction or raise a charge-back in relation to an online paid order, you should contact Delight Burger in the first instance using the contact details provided below or on the Website/Application. Where appropriate, Delight Burger may liaise with Orderra and/or Ryft in order to review your request.

If an unrecognised transaction appears on your card/statement in connection with an order placed via the Website/Application, please contact Delight Burger or use the contact details provided on the Website/Application as soon as possible so that the issue can be investigated.


7. Order Cancellation and Amendments

Once an order has been confirmed and payment has been taken from your account, you may not be able to cancel your order and you may not be eligible for a refund, particularly where food preparation has already begun.

If you wish to change or cancel your order, you should contact Delight Burger as soon as possible using the contact details provided on the Website/Application. Where feasible, Delight Burger will attempt to accommodate your request but cannot guarantee that changes or cancellations will be accepted once the order is in progress.

Orderra may, where appropriate, assist in facilitating communication between you and Delight Burger, but has no obligation or responsibility to approve or guarantee any change, cancellation or refund.


8. Feedback

If the order received does not meet your expectations, you can provide feedback to Delight Burger via the feedback page on the Website/Application or via any other feedback channel made available. Feedback submitted may be reviewed and, where appropriate, displayed on the respective Takeaway’s page, subject to moderation.


9. Compensation

If you are unhappy with the quality of any goods or the service provided by Delight Burger and wish to seek any form of compensation, you should contact Delight Burger directly to raise your complaint and, where appropriate, follow Delight Burger’s own complaint procedures.

Orderra and RestaJet have no control over Delight Burger and the quality of the goods or service that it provides. Neither Orderra nor RestaJet is able to provide, and accepts no responsibility or liability for providing, any compensation to you on behalf of Delight Burger.


10. Customer Support

Orderra may provide customer support services in connection with your use of the Website/Application and your online order.

You can contact customer support by using the “Contact Us” or similar section on the Website/Application and submitting your request via the provided contact form or other published contact method.

If you are unhappy with the service provided in relation to the Website/Application itself, please use the contact details provided on the Website/Application to submit a complaint. Your complaint will be reviewed and handled in accordance with the applicable complaints process.


11. Privacy Policy and Terms of Use

Use of our Website/Application is also governed by our Privacy Policy and Website/Application Terms of Use, which are available on the Website/Application. Our Privacy Policy and Website/Application Terms of Use are incorporated into these Terms and Conditions by this reference.


12. Variation

Delight Burger shall have the right, in its absolute discretion and at any time, to amend, remove or vary the services and/or any page of the Website/Application, including these Terms and Conditions, subject always to applicable law.


13. Invalidity

If any of the provisions of these Terms and Conditions are found to be unlawful, invalid or otherwise unenforceable by any court or other authority, that/those provision(s) will be deemed severed from the remainder of these Terms and Conditions and the remainder will continue to be valid and enforceable.


14. Waiver

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.


15. Law and Jurisdiction

These Terms and Conditions, and the relationship between you and us (whether contractual or otherwise), shall be governed by and construed in accordance with the laws of England & Wales.

If you are a consumer, you will benefit from any mandatory provisions of the law in your country of residence. Nothing in this clause takes away or reduces your rights as a consumer to rely on those provisions.

Any dispute, controversy, proceedings or claim between you and us relating to these Terms and Conditions, or the relationship between you and us (whether contractual or otherwise), shall be subject to the jurisdiction of the courts of England, Wales, Scotland or Northern Ireland, as determined by your residency.
